3.3 Content Standards

RustBaseDesigns reserves the absolute and unconditional right to develop, modify, enhance, discontinue, or create derivative works of the Service at any time, in its sole discretion, without notice or liability. This includes but is not limited to:

  • Developing new features, products, or services
  • Modifying existing functionality
  • Creating derivative works or spin-off products
  • Integrating the Service with other platforms or services
  • Using data and insights from the Service to develop new offerings
  • Commercializing any aspect of the Service or developments thereof

You acknowledge that RustBaseDesigns retains all rights to the Service and any developments, improvements, or enhancements thereof, regardless of whether such developments are based on user feedback, user behavior, or any other source. RustBaseDesigns does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service is free of viruses or other harmful components

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSTBASEDESIGNS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Unauthorized access, use, or alteration of your content
  • Any other matter relating to the Service

IN NO EVENT SHALL RUSTBASEDESIGNS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless RustBaseDesigns, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your violation of any rights of another party
  • Your User Content

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RustBaseDesigns operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
